Please read these Terms of Service ("Terms") carefully before using WarSales ("the Platform", "we", "us"). By registering an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Who We Are

WarSales is an online peer-to-peer marketplace for the buying and selling of militaria collectibles. The Platform is operated from Slovenia. The Platform facilitates connections between buyers and sellers but is not itself a party to any transaction.

2. Eligibility

• You must be at least 18 years old to register an account.
• By registering, you confirm that all information you provide is accurate and truthful.
• You may not create multiple accounts. If your account is suspended or banned, you may not create a new one.
• Accounts are personal and non-transferable.

3. The Platform's Role

WarSales provides the tools and infrastructure for buyers and sellers to interact. We do not:

• Process payments between buyers and sellers
• Take ownership or possession of any items listed
• Guarantee the quality, authenticity or legality of any item
• Act as a financial intermediary or escrow service

Transactions are conducted directly between users. WarSales is not liable for the outcome of any individual transaction.

4. Seller Obligations

• Listings must be accurate, complete and not misleading in any material respect.
• You must own or have the right to sell the item listed.
• You must comply with all applicable laws in your jurisdiction, including export controls, import restrictions, and laws governing the sale of weapons and historical artefacts.
• You must not list prohibited items (see Section 6).
• You must respond to buyer enquiries within a reasonable time.
• If a sale is agreed, you must ship the item as described and within the agreed timeframe.
• All communication with buyers must remain within the WarSales messaging system until a transaction is complete.

5. Buyer Obligations

• You must not make bad-faith enquiries or offers with no intention to complete a transaction.
• You are responsible for verifying the legality of importing or owning any item you purchase in your jurisdiction.
• You must keep all pre-transaction communication within the WarSales messaging system.
• Payments must be made in good faith. Attempting to reverse a legitimate payment (chargebacks for completed transactions where goods were received) may result in account suspension.

6. Prohibited Items

The following items are strictly prohibited on WarSales:

• Items illegal to sell, own or transport in the seller's or buyer's jurisdiction
• Stolen goods or items with unlawful provenance
• Confirmed counterfeits or forgeries presented as originals
• Reproductions presented as originals (all reproductions must be clearly and prominently labelled)
• Live ammunition, explosives, or functional weapons that require a licence to sell
• Items primarily intended to promote hatred, violence or terrorism

Nazi and Third Reich era items may be listed for historical collecting purposes only. WarSales reserves the right to decline, remove or restrict any listing at its sole discretion.

7. Content and Intellectual Property

By posting content (photos, descriptions, messages) on WarSales, you grant us a non-exclusive, royalty-free licence to display that content on the Platform for as long as the listing is active. You retain ownership of your content and are responsible for ensuring you have the right to post it.

The WarSales name, logo, and platform design are our intellectual property. You may not reproduce, scrape or redistribute them without our express written consent.

8. User Conduct

You agree not to:

• Harass, threaten or abuse other users
• Post spam, automated messages or unsolicited commercial communications
• Attempt to bypass our moderation or security measures
• Use the Platform to facilitate transactions for prohibited items
• Collect or harvest other users' personal data without consent
• Impersonate another user, company or WarSales staff

9. Moderation and Enforcement

We review all listings before publication. We reserve the right to remove any listing, issue warnings, suspend or permanently ban any account, with or without prior notice, for violations of these Terms or our Seller Guidelines. We are not required to provide detailed reasons for moderation decisions.

10. Disclaimer and Limitation of Liability

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of malicious code.

To the maximum extent permitted by law, WarSales shall not be liable for:

• Any loss arising from a transaction between users
• The authenticity, condition or legality of any item listed
• Any indirect, incidental, special or consequential damages
• Loss of profit, data, or business opportunity

Our total liability to any user, where applicable, shall not exceed €50.

11. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email or via a notice on the Platform at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Slovenia.

We encourage users to contact us first to resolve disputes informally before initiating legal proceedings.
